Major 2026 firearm-law changes and court decisions

HS 1 for HB 427 — Youth Hunting & Target Practice
Signed August 17, 2026 (85 Del. Laws, c. 430). Adjusted the direct-supervision rules for qualifying 16- and 17-year-olds engaged in target practice or hunting.


HB 418 — Unserialized Firearms
Signed and effective September 3, 2026 (85 Del. Laws, c. 469). Created a compliance pathway for qualifying previously possessed unserialized firearms and unfinished frames or receivers.


DSHS v. Birney — Delaware Supreme Court
Decided September 8, 2026. The Delaware Supreme Court reversed the Superior Court; Delaware’s challenged under-21 restrictions remain enforceable subject to statutory exceptions.


HB 342 — Out-of-State Protection Orders
Signed and effective September 14, 2026 (85 Del. Laws, c. 508). Expanded Delaware’s prohibited-person law to certain qualifying out-of-state domestic-violence protection orders.


SS 1 for SB 300 — State Firearm Dealer Licensing
Signed September 3, 2026 (85 Del. Laws, c. 467). Creates a new state firearm-dealer licensing framework under Title 24 with phased implementation; dealers should consult the enacted text and DSP implementation materials.


HB 141 w/ HA 1 — Firearm Responsibilities Notice
Signed in 2026. House Amendment 1 changed the Act’s effective-date trigger to publication in the Register of Regulations of notice that the final Firearm Responsibilities Notice is ready.

Title 24 — Delaware deadly-weapons dealers

Title 24, Chapter 9 contains Delaware’s existing deadly-weapons dealer licensing, records and transfer-facilitation provisions. In September 2026, SS 1 for SB 300 was signed into law and created a new firearm-dealer licensing framework under Chapter 9B with phased implementation. Dealers should distinguish the provisions currently in force from requirements whose operative dates are still in the future.

Title 24, Chapter 9 — Deadly Weapons DealersIncludes §901 licensing, §904 dealer records and §904A dealer-facilitated private-transfer procedures.

SS 1 for SB 300 — New Chapter 9B Firearm Dealer Licensing FrameworkSigned September 3, 2026. Creates the future/phased state firearm-dealer license, security, recordkeeping, training, inspection and enforcement framework.

FFLs and Delaware deadly-weapons dealers should always verify the current statutory text, SBI procedures and any newly effective legislation before relying on an older compliance checklist.
